1. Agreement to Terms

By downloading, installing, or using the PushBlock mobile application ("the App"), provided by Escalate Apps ("we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not install or use the App.

2. Description of Service

PushBlock is a digital wellness and fitness application designed to help users moderate screen time by requiring physical exercise repetitions (such as push-ups, squats, crunches, or jumping jacks) to unlock user-selected applications on iOS and Android devices.

3. Important Physical Health & Exercise Disclaimer

PLEASE READ CAREFULLY BEFORE EXERCISING:

  • Exercise at Your Own Risk: Physical exercise carries inherent risks of injury. You should consult a physician or qualified healthcare provider before initiating any physical exercise routine.
  • Listen to Your Body: Never overexert yourself. If you experience discomfort, dizziness, shortness of breath, or pain while completing reps in PushBlock, stop exercising immediately.
  • No Medical Advice: PushBlock is not a medical device and does not provide medical diagnoses or healthcare advice.
  • Limitation of Fitness Liability: Escalate Apps shall not be held liable for any physical injury, strain, accident, or health condition arising from workouts or physical activities performed in connection with the App.

4. Subscription Services & Purchases

PushBlock offers auto-renewable Pro Subscriptions (e.g., Monthly or Annual plans) and lifetime access options:

  • Billing & Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours prior to the end of the current billing period.
  • Payment Processing: Payment is charged to your Apple ID or Google Play Account at confirmation of purchase.
  • Subscription Management: You can manage or cancel your subscription anytime via your Apple ID Account Settings or Google Play Subscription Manager.
  • Refunds: All purchase transactions and refunds are governed by the Apple App Store or Google Play Store refund policies.

5. Free Tier Usage

PushBlock provides a free tier allowing basic app blocking and exercise rep counting. Advanced features, such as unlimited app blocking, custom exercise targets, detailed analytics, and rank rewards, require an active Pro subscription.

6. User Responsibilities & Emergency Access

You agree to:

  • Use the App in a safe physical environment free of obstacles or hazards.
  • Maintain the security of your device and app store credentials.
  • Not rely on PushBlock for critical device security or emergency app lockdown. Never block essential emergency communication tools (e.g., Phone, Emergency Services).

7. Prohibited Uses

You agree not to:

  • Decompile, reverse engineer, or attempt to derive source code from PushBlock.
  • Bypass or attempt to tamper with app blocking mechanisms or subscription checks.
  • Use PushBlock for any unlawful purpose or in violation of local laws.

8. Intellectual Property

The App, including its visual design, original code, logos, trademarks, and algorithms, is the exclusive intellectual property of Escalate Apps and is protected under international copyright and trademark laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESCALATE APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, OR GOODWILL RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

11. Platform-Specific Terms (Apple & Google)

If you downloaded PushBlock from the Apple App Store or Google Play Store:

  • You acknowledge that these Terms are between you and Escalate Apps, not Apple or Google.
  • Apple and Google have no obligation to furnish maintenance or support services with respect to the App.
  • Apple and Google are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.

12. Termination

We reserve the right to suspend or terminate your access to the App if you violate any provision of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable governing laws, without regard to conflict of law principles.
